The Heart of a Republican

by @ 8:20 pm. Filed under Law & Politics

Eugene Volokh is a far smarter man than I, has much better (and professional) knowledge of law, and is a subtler thinker. So when he posts things like this, I can only shake my head at the different ways that people view the world.

Volokh doesn’t even attempt to logically justify his opinion, other than by an appeal to ‘justice’, that disgustingly noble coating with which nature has covered our instinct for revenge. I challenge anyone to look at this picture and tell me that the Iranians are better people or a better society for punishing a man that way, no matter what his crimes.

I find myself on balance persuaded by Mr. Volokh. Do you have any answer to his response to you?

  2. bob greene Says:

I completely agree with Volokh on this issue. The logicla argument is paying back the evil savage in spades the pain he inflicted on another human being. It closes the book. Just as self defense is proper and assalt is not, making thses slimeball suffer is th eright thing to do. I believe it reaffirms my humanity if I inflict horrible pain upon a person who molested one of my children. In brief , hanging is too good for them. I want these scumbags to SUFFER and SUFFER an dSUFFER some more.

  3. Joe Snuffy Says:

Yes, Iran is a better society for killing that bastard in that manner. We would be too if we took sick bastards like that out and put them down in the most painful way imaginable. Take for example M. Jackson…. the guy has nude pictures of children and sleeps with them. Regardless of whether he actually assaulted any of them, he’s a sick bastard that is certainly not improving society through his existence. Perhaps Jessica Lunsford wouldn’t be missing if we actually hung pederasts, murderers, and rapists. Instead, we let them back out to strike again. Tell me which society is actually using it’s brain. If anyone so much as touched my child, they’d better pray that the cops get to them before I did. And when I was done ripping their limbs off, I’d go back to being the same Joe Citizen I am now.

Frankly, the whole “veneer of civilization” schtick is tiresome. You are a sheep. That’s fine…nothing wrong with that…but sheep should not be making laws when it is the sheep-dog that protects them.

  4. salaryman Says:

I agree with Shelby above — as Volokh points out in his response, you don’t even “attempt to logically justify [your] opinion” any more than he does. Most people’ moral intuitions about weighty issues are irrational in the sense that they are founded on life experiences, including what their parents taught them and what were the prevailing norms in the culture they were raised in rather than on any “attempt to logically justify” or formulate a philosophical position on anything. That doesn’t mean that you (or Prof. Volokh) are “wrong” for holding your deep moral intuitions on such a basis — it just means that “logically justifying” such intuitions is beside the point.

  5. ss Says:

I took up your challenge. I looked at the picture. Made me want to whack the bastard myself for what he did to a bunch of little kids. Liberals tend to say that revenge or justice is inhuman when applied to criminals, but then wish that humiliation and harm would come to the President of the United States for his alleged “arrogance” and “lies.”

  6. Don Kosloff Says:

Excellant job by the Iranians in this case. What is particularly lame is the claim that justice is merely a false concept invented to hide the fulfillment of the need for revenge. That is a stunningly absurd claim. In the US the murderer always triumphs, he gets what he wants, a dead victim. Even if a murderer is promptly executed, he still comes out ahead. Even the monster in the Iraniam case came out ahead. He suffered a lot less than his victims.

  7. Dan Says:

Well speaking of ’stunningly absurd claims’, thanks for some nice examples of them, Don.

  8. Don Kosloff Says:

I made no claims, absurd or otherwise. I only described facts.

  9. Cady Says:

Hey Dan, I tried to follow the link but it wasn’t working…can you help? I’d like to look at the article.
